A contract can be defined as an agreement between two or more parties to do or to refrain from doing an act which aims to set legal relationships. This is commonly the same for sale agreements during the sale of Jamaica beachfront houses. Here are two basic agreements of a contract, they are as the following:

(a) An agreement means the same things to both parties and it should be fully understood by them.

(b) It is not an exchange of promises, the contract aims to create legal relations.

Essentials of a Valid Contract
A contract consists of the following elements and will get into force only if these elements exist:

1. Offer and Acceptance ? there should be an offer for Jamaica real estate for sale by one side (called as the vendor) and an acceptance of it by the other side (called as the buyer);

2. Consideration ? Each party should give consideration (excluding contracts under seal);

3. The goal to set legal relations ? The parties should understand that their agreement is to be legally binding;

4. Capacity ? each party should have legal capacity to conclude the contract;
5. Form ? the contract should be compliant with a particular legal form.

6. Permission should be genuine ? The contract should not be induced by duress, misrepresentation, undue influence or fraud;

7. Legality of purpose ? Contracts should not be concluded for an illegal purpose;

8. Possibility of performance ? it should have capability to be performed.

Void, Voidable and Unenforceable Contracts
A contract that does not meet above requirements may be:

(a) Void ? The contract is completely inoperative and is automatically treated. It should be taken into account that neither goods can be restored to their initial owners nor the party can be enforcing it. It means that until the contract can be legal an individual would not allowed selling the property, in other case it would be illegally. Illegal contracts or those that were composed by mistake are traditionally void.

(b) Voidable ? This contract is valid until one of the parties chooses to terminate it. From the date of decision the contract is out of action. The party that has taken such a decision charge for the reasonable remedy of recession just to recover any money or goods that were given out to the other party. However, the rescission can bring back the parties to the same position that they were in before when the contract was composed, but it differs from the contract to be made void. Contracts induced by misunderstanding, undue influence or duress are considered to be void.

(c) Unenforceable ? The contract is valid if the parties carry out it but it can not be enforced in law if one of the parties fails to do this.

The individual that makes the offer is called offeror and the person to whom the offer is made is called the offeree. The main feature of an offer is that it should be made with the aim to be accepted without qualification by the offeree. The offer should be made in written or oral from.
